1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and OrcaHive (owned and operated by Abdallah Hussein), governing your access to and use of the OrcaHive.io platform and services.

By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access or use our Service.

2. Service Description

OrcaHive.io is a Software-as-a-Service platform that enables users to:

• Create, configure, and deploy AI-powered chatbots for customer engagement
• Integrate chatbots into websites and applications through embedding technology
• Access analytics and conversation logs for chatbot interactions
• Manage chatbot knowledge bases through document uploads and text input
• Customize chatbot appearance and behavior

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Eligibility and Account Registration

3.1 Eligibility Requirements

To use OrcaHive.io, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Provide accurate, complete, and current registration information

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use or security breach

4. Subscriptions, Billing, and Payments

4.1 Payment Processing

Payments are securely processed through trusted payment partners, such as Kashier (for local payments in Egypt) and other authorized processors for international transactions.

4.2 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless canceled before renewal. You can cancel your subscription at any time through your account dashboard.

4.3 Taxes

All fees are exclusive of applicable taxes. You are responsible for paying any taxes required by your jurisdiction.

5. Refund and Cancellation Policy

5.1 No-Refund Policy

Due to the digital nature of our Service, all payments are non-refundable except as required by applicable law.

5.2 Limited Exceptions

Refunds may be issued at our discretion in cases of:

• Duplicate billing or technical charging errors
• Extended service downtime
• Within 14 days of initial subscription for first-time users who have not actively used the Service

5.3 Cancellation

You may cancel your subscription at any time. Upon cancellation:

• Your access to paid features continues until the end of your billing period
• No refunds will be provided for unused time
• Your account may revert to a free plan or be deactivated

6. Acceptable Use Policy

6.1 Prohibited Activities

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Transmit malicious software or harmful code
• Harass, abuse, or harm others
• Use the Service for any illegal or deceptive purpose

6.2 Prohibited Content

You may not create chatbots that:

• Promote illegal activities, violence, or hate speech
• Violate third-party rights
• Facilitate fraud
• Provide medical, legal, or financial advice without disclaimers
• Target or exploit minors
• Contain adult or explicit content

7. Intellectual Property Rights

The OrcaHive platform, software, code, design, and trademarks are owned by Abdallah Hussein, the creator and operator of OrcaHive.io.

You retain all rights to your own chatbot content and data. By submitting content to the Service, you grant us permission to use it solely to operate and improve the Service.

Important:

We do not use your content or conversation data to train general AI models.

8. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

We do not guarantee that:

• The Service will meet all your requirements
• The Service will be uninterrupted or error-free
• Any issues will be corrected immediately

9. Limitation of Liability

To the maximum extent permitted by law, OrcaHive and its owner (Abdallah Hussein) shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

Our total liability for any claim shall not exceed the amount you paid for the Service in the last 12 months, or $50 USD, whichever is lower.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Arab Republic of Egypt, without regard to conflict of law principles. For users in the European Union, we also comply with the EU General Data Protection Regulation (GDPR).

11. Changes to Terms

We may update these Terms occasionally. Material changes will be announced via email or on our website 30 days before they take effect. Continued use of the Service after such notice means you accept the revised Terms.
